Trial Begins in SF Hate Crime Case

SAN FRANCISCO (KRON) -- After more than a year, closure may be near for some Asian American families in San Francisco who say their teenaged sons were victims of a hate crime.

On one side of the courthouse hallway, three of the victims (Jeff Woo, Paul Wong Jr., and Sung Noh) and their families appeared on the the first day of trial in the highly charged assault case.

On the other side, the teenager accused of being one of their attackers and his family waited.

"They crossed paths one fateful night and it was motivated by race," claims victims families' lawyer Edwin Prather.

That's the charge: On June, 2003, at 19th St. and Taraval, a large group of young white males attacked five Asian teenagers after hurling racial taunts.

Police say a mob of about 15 mostly high school aged white males had left Stern Grove after officers broke up a keg party.

At the intersection of 19th St. and Taraval, investigators say they encountered the five asian teenagers. First they say came the taunts, then the violence.

"Some of the victims were knocked to the ground. Some were chased. Some were thrown up against walls and punched. All with racial epithets being said. Different derogatory terms directed against Asian Americans, things like 'ching chong, gook, chinaman,' et cetera," explains attorney Prather.

It became a high profile case with Asian Americans and civil rights groups rallying behind the victims and their families. Last August, Mayor Willie Brown and other elected representatives appeared at a rally at City Hall with the Police Chief, promising a full investigation into the attack.

One juvenile has been charged with felony assault with a hate crime enhancement. Police did not have enough evidence to charge others.

As for the victims families, they would like to send a message. "When people beat other people like that and calling them names, it's just not right," says victim's father Bill Woo.

The defendant's name is being withheld because he's a minor.

Juvenile trials are usually closed to the public but the judge in this case has decided to open it to the media because of the seriousness of the charges.

SAN FRANCISCO -- First came the racial insults, then the beatings. The victims: five Asian-American teenagers attacked in San Francisco by a mob. It is an attack that angered members of the Asian community. Now, a year later, the hate crime trial has begun.

The unprovoked attack happened at 19th and Taraval. The young beating victims: Sung Noh, Tim Wen, Jeff Woo, Paul Wong, Jr., and Ken Zeng.

"We just wanted to get some dessert and have a good time," Paul says. "We just graduated and we just wanted to enjoy ourselves, but unfortunately we encountered those guys that night."

"Those guys" were a group of about 15 to 20 mostly high school-aged white males.

Jeff says, "There was a guy who poured beer over my head as he was passing by and there was a whole group of people who were saying racial things to us, like they were calling us Chinaman and this guy was imitating the old chinese music saying, 'ding, dong, ping, pong' kind of stuff."

The racial taunts they say suddenly turned to violence. The five were chased, surrounded and beaten.

Ken says, "I was thrown against the wall and punched in the face and while that was happening they were laughing, calling us names... calling us gooks, imitating our language, saying, 'ching, chong' things like that."

It has been more than a year now. The trial started last week, but only one juvenile suspect is on trial. Police did not have enough evidence to charge others.

Unlike many other hate crimes, all five victims -- with the support of their parents -- are testifying.

"They're so strong and I'm so tremendously proud of them," their lawyer Edwin Prather says. "They've had to deal with it 365 days-plus and to go through this ordeal is a tremendous victory in a sense for them."

But the alleged racially-based beating has tragically destroyed their wonderful innocence.

"I think about it quite a lot," Ken says. "... The things they said... like when they were beating on you. It makes you feel, it takes your pride away. It makes you feel very, very small. I'm not important, you know... "

None of them thought something like this would happen in San Francisco.

Ken says, "I've always felt safe here. I mean, I've never, I've never, like, had any racial crimes or any prejudice directed toward me."

"It's a pretty diverse place. It's a pretty liberal place, so I guess I just didnt expect something like this to happen," Tim says. "I always thought people could be equal and could live together... but you know, it definately brings up an equality question in your thoughts in the back of your mind."

Paul says, "To act upon that feeling that you hate someone because of their ethnicity and it's just scary out there that people would actually do something like that."

I think an important goal for political activists, letter writing citizens, and lawyers would be to push for laws that raise the penalty for hate crime assaults to level high enough to serve as an effective deterrent.

question is why would a group of teen-age students attack in the first place? who or what has implanted the hatred. they have been manipulated by the masters of racial hate - kkk, neo-nazi, skinheads etc.

how - the constistent effort to create racial disharmony through any means possible, film, television, recruitment, prisons, newspaper, pr. who benefits the most with racial disharmony - the supremist groups. it's the divide and conquoer tactic of the modern age.

the civil rights movement of the 60's is almost becoming nothing but a lost memory. it proves the success of the white supremist think tanks. their hope is that the philosphy of hate will spread world wide. their intent is a race war.

even here at modelminority.com it's obvious the race hatred that alot of the members possess. but if it really came down to a race war asians and asian americans would wiped out in a second. no unity, no strategy, no army conversly supremist have a strategy, an army, a weapons stockpile, member politians, a long term goal.
something very much considering.

hate however cannot be overcome with hate. what the solution is hard to determine......................

The reason why this type of situation is a problem is because you all seemed to be surprised—the victims, their parents, politicians, and readers. Why is this behavior to be unexpected? There is obviously a very different attitude that Asians from the West Coast have from Asians residing in the East Coast. We know—those of us who live in NYC—that this can happen. We know that 10-year-old kids can think this why about us; we know that it is necessary to maintain a certain type of demeanor on the subway or walking on the street (that is how you remain safe and attack free). Shit only happens when you are not prepared. You guys out there in La-La Cali-land need to know what the average peasant immigrant from Fujian knows here: there is no price for one's honor; take shit from no one—or get beaten, raped, robbed, or killed. If you cannot figure out how to defend yourself and prepare to meet your enemy, then you deserve to get whatever they dish out. California Asians need to wake-up and get-off the Prozac!

man. dumb fucks. how much damn evidence do they need? i mean all these punks were beating these kids and calling them racial slurs. What kind of shit is this? I'm glad they can at least charge one. But what about the others, how long is it going to take before they do it again. And when they do, are they going to say it again, say oh we don't have enough proof. That's bullshit.

Couldn't locate it or any other news on this topic, so I can't cut and paste it for you here, but I can type some of the news.

The judge (God bless him) "has ruled that a white teenager committed felonious andmisdemeanor assault in a hate crime against three Asian American teenagers last year."

" 'There's no doubt this was a hate crime motivated by racial prejudice," San Francisco Superior Court Judge Kevin McCarthy said Weddnesday. "These are victims of the most despicable behavior one can imagine." '

"The white teenager had faced 10 felony and misdemeanor counts of assault and battery with a hate crime enhancement. On Wednesday, the judge ruled on two counts of felony assault against victims Jeff Woo and Ken Zeng with hate crime enhancement; one misdemeanor battery against Paul Wong; and three hate crime misdemeanors against Woo, Zeng, and Wong.

1) Legal minds can aim for much severer penalities for hate crimes

2) Activists can march and protest, using the media to focus on the problem

3) Schools and community organizations can organize "awareness and self defense strategies" for youths and other people.

Hate crimes are on the rise against not just Asians, but other ethnic minorities as well, like the Mexican family recently

There needs to be some organized network of groups and actions.

The only way to actually make the legal system fair for all minorities is to place minorities within the legal system, because lets be honest most judges and attorneys are white.

Let us start by looking at the most powerful element involved in the characterizing of groups of people. As a former reporter for a prominent newspaper and producer for CBS News, I know first-hand the colossal power the media has in shaping people’s opinions about others.

Newspapers, magazines, radio, television, motion-pictures, and even books seem to have the same thing in common – the way they portray particular groups of people. The scariest part is how often people let a six-inch newspaper article, a minute and 30-second television news package, or a feature film imbed a commonality in their beliefs, negative or otherwise, about entire groups of people.

Asians, of course, are made out to be a submissive culture, people who are weak and dominated by society.
Gays are typecast as effeminate and, more often times than not, perverse child molesting sex freaks.
Blacks, well of course all Black people know what a jail cell looks like, right?

Producers, writers, movie-makers, and the like need to start being more cognizant of the affects their “creativity” is having on society. However, because these seemingly insensitive, power-hungry, attention-striving people have the “free speech” curtain to hide behind, we will just have to be even more careful and selective of what we let our children watch – thank God for the V-Chip!

Never believe everything you hear – be more intelligent and responsible to do a little research of your own on the topic. Teach your children to think for themselves.

Never underestimate the predominance the mass media has in influencing us!
